These Terms of Use ("Terms") govern your access to and use of the funere.com website and its services (collectively, the "Service"), operated by Funere SA (c/o Alessandro Soldati, Strada Regina 41, 6991 Neggio, Switzerland) ("Funere"). By creating an account, placing an order or using any part of the Service, you agree to be bound by these Terms, as well as by our Privacy Policy. If you do not accept these Terms or the Privacy Policy, you must not use the Service.
These Terms constitute a legally binding agreement between you (the user) and Funere. Please read them carefully. If you use the Service on behalf of a company or another legal entity (for example, a funeral home or an association), you represent that you have the authority to bind that entity to these Terms.
The Service is primarily oriented towards the Swiss market: paid services (in particular the delivery of memorial flowers) are performed in Switzerland, and the content mainly relates to deceased persons and ceremonies in Switzerland. The Service is nevertheless accessible to users located outside Switzerland, in particular to relatives and members of the diaspora wishing to consult death notices, express their condolences or order a memorial service performed in Switzerland.
If you access the Service from abroad, you do so on your own initiative and are responsible for complying with the local laws applicable to you. You must be at least 18 years old (or the age of majority under the law applicable to you) and capable of entering into a binding contract in order to use Funere.
We do not knowingly offer the Service to minors. We reserve the right to refuse access to the Service to anyone, or to restrict certain features based on the user's location, at our discretion.
funere.com is a Swiss digital platform dedicated to death notices, tributes and memorial services. Our services include:

Account creation: To use certain features of the Service (such as publishing a death notice, adding a condolence, creating a memorial alert or managing donations), you must register for a user account. During registration, you must provide a valid email address and your name. Access to the account is passwordless: a one-time login code is sent to your email address each time you sign in. If you create an account on behalf of an organisation (funeral home, association or other entity), you must provide the organisation's details as requested and have the authority to do so.
Account information: You agree to provide truthful, accurate and complete information during the registration process and to keep your account information up to date. This includes promptly updating any contact or business information if it changes. Funere is not responsible for any losses or issues arising from inaccurate or outdated information you provide.
One account only: Each user or business entity may maintain only one account, unless we explicitly authorise otherwise (for example, you may have a personal account and a separate organisation account depending on the design of our Service). You may not create an account using a false identity or on behalf of someone else without authorisation.
Access security: Authentication to the Service is based on a one-time login code sent to your email address. The security of your Funere account therefore depends directly on the security of your email inbox. You are responsible for maintaining secure access to your email address and for not sharing the login codes you receive with anyone. If you suspect that your account has been compromised (for example, if you notice unauthorised activity or lose control of your email address), you must notify us immediately through our support contact.
Account use: You are responsible for all activities that occur under your account. Any action taken through your account will be presumed to have been authorised by you. Funere will not be liable for any losses or damages resulting from your failure to protect access to your email address or your login codes.
Unauthorised access: We reserve the right to suspend or terminate any account that we believe has been compromised or is being used fraudulently or in violation of these Terms, in order to protect you, Funere and other users.
Multiple sources: The information published on funere.com comes from various sources, including:
Data submitted directly by users and families
Public sources (civil status registers, archives, etc.)
Newspaper and media publications
Funeral homes and industry professionals
Third-party databases and information services
No guarantee of accuracy: Given the diversity of sources and the sensitivity of the information, we cannot guarantee the accuracy, completeness or timeliness of all published information. The data is reproduced and presented for informational and memorial purposes only. We strive to maintain the quality and accuracy of the information, but errors, omissions or outdated information may occur.
Limited use: All content available on funere.com is intended exclusively for personal and memorial use. Commercial use, resale of information or exploitation of the data for profit without our explicit written authorisation is strictly prohibited.
Modification process: Any request for modification, correction or removal of a death notice or associated information must be submitted through our contact form available at https://www.funere.com/ch-en/contact. We undertake to process these requests promptly, generally within 48 working hours.
Legitimate requests: Requests from close family members, legal representatives or persons with a legitimate interest will be treated as a priority. Supporting documentation may be requested to verify the legitimacy of the request.
Third-party rights: We respect the rights of third parties and will diligently handle any claim regarding inaccurate information, privacy violations or inappropriate content. In the event of a dispute concerning the publication or modification of information, we reserve the right to temporarily suspend the display of the contested content while the situation is reviewed.

The free offering is provided as a courtesy to allow access to basic memorial features. Funere reserves the right to modify the free features, impose limitations or remove certain aspects of the free offering at any time, with reasonable notice.
Paid services:
Paid services include in particular premium features, the sale of memorial flowers (Article 9) and the sale of memorial trees (Article 10). They are offered at the prices displayed on our site at the time of ordering. Unless otherwise indicated, all prices are displayed in Swiss francs (CHF) and are inclusive of all taxes (Swiss VAT included).
Formation of the contract: The contract is concluded when your payment is validated by our payment provider. You then receive an order confirmation by email. Funere reserves the right to cancel an order if it cannot be fulfilled (for example, geographic area not covered, partner unavailable, manifestly incorrect information). In such a case, the amount paid will be refunded to you in full, and this refund constitutes your sole remedy.
No-refund policy: Due to the sensitive, personalised and date-specific nature of memorial services, orders cannot be cancelled by the customer after payment, and payments are final, subject to mandatory provisions of Swiss law. A refund is made only if the service cannot be performed at all, in accordance with the terms set out in Articles 9 and 10. We provide detailed information about each service and encourage users to assess their needs before making a purchase.
Seller: Funere SA sells memorial flowers in its own name and for its own account. The preparation and delivery are entrusted to fulfilment partners selected by Funere (funeral homes, florists or other providers).
Reference values: Memorial flowers are offered in the form of reference values (for example CHF 120, CHF 200, CHF 500). By ordering, you choose a value, not a specific floral arrangement. The fulfilment partner freely creates the most dignified and appropriate arrangement for the occasion, the season, local availability and the chosen value. No particular variety, colour or shape is guaranteed. The visuals displayed on the site are simple symbolic icons and do not constitute a representation of the arrangement that will be delivered.
Order information: You are responsible for the accuracy of the information provided when ordering (name of the deceased, place, date and time of the ceremony, contact details). Funere and its partners cannot be held liable for delayed or modified fulfilment resulting from inaccurate or incomplete information.
Delivery: The flowers are in principle delivered to the ceremony venue before the ceremony. If delivery before or during the ceremony is not possible (in particular in the event of a late order, a change to the time or place of the ceremony, or circumstances beyond our control), the flowers are placed on the grave or handed over to the family, according to the family's wishes. These alternative delivery arrangements constitute valid fulfilment of the order and do not give rise to any refund, in whole or in part.
Fulfilment confirmation: You receive an email confirming that your order has been fulfilled. No photographic proof or other delivery documentation is provided.
Accompanying message: You may attach an accompanying message to your order. Funere reserves the right to refuse or not reproduce any message that is inappropriate, offensive or contrary to the dignity requirements set out in Article 14. In such a case, you will, where possible, be invited to amend the message; failing that, the order may be fulfilled without a message, without this giving rise to a refund.
Cancellation and refund: The order cannot be cancelled after payment. A full refund is made only if the order cannot be fulfilled at all, that is, if the flowers can neither be delivered to the ceremony, nor placed on the grave, nor handed over to the family.
Nature of the service: The memorial tree is a symbolic service whereby a tree is planted in memory of the deceased. Funere SA is the direct seller of this service. The planting is carried out by a specialised partner.
Planting arrangements: The trees are planted according to the schedule, planting areas and practices of our partner, taking into account in particular seasonality and local conditions. Additional information about the planting is available on request via our contact form.
Scope of the service: The customer does not acquire any ownership right or any other right in rem over the planted tree or the planting land. The service does not include individual geolocation, visits, a certificate or photographic tracking of the tree. Any additional communication that may be provided (for example a commemorative document) is provided purely as a courtesy and does not constitute a contractual commitment.
Survival of the tree: The planting is carried out professionally by our partner and in accordance with the partner's conditions. Funere does not guarantee the individual survival of the tree beyond planting.
Cancellation and refund: The order cannot be cancelled after payment. A full refund is made only if the planting cannot be carried out at all.
Role of Funere: Funere provides charitable associations with a technical infrastructure for collecting memorial donations. Funere does not act as a financial intermediary within the meaning of Swiss anti-money laundering legislation (AMLA) and does not provide any payment services on behalf of third parties.
Donation flow: Memorial donations are in principle paid directly to the beneficiary association, via the association's own Stripe Connect account, set up with technical support from Funere. In such cases, the funds do not pass through Funere SA: the donation contract is concluded directly between the donor and the association, and Funere acts solely as the provider of the technical infrastructure.
Transitional situation: On an exceptional and temporary basis, in particular pending the setup of an association's Stripe Connect account, donations may pass through Funere SA's Stripe account. In this case, Funere undertakes to transfer the full amounts collected, less only the payment processing fees charged by the payment provider, to the designated association. These transfers are made at regular intervals, in principle on a monthly basis, or as soon as the amount collected reaches the minimum threshold allowing an efficient transfer.
Fees: Funere SA does not charge any management commission or administrative fees on memorial donations. The only applicable deductions correspond to the payment processing fees charged by the relevant payment service provider, such as Stripe.
Distinction from sales: Memorial donations are distinct from the commercial services of the Service, such as the sale of memorial flowers (Article 9) and memorial trees (Article 10). For these commercial services, Funere's remuneration is included in the displayed price.
Traceability and transparency: For donations that have passed through Funere's account, we maintain an accurate register of the amounts collected and the transfers made to each association. Upon justified request, we can provide information on the status of your donation and the planned or completed transfer date to the association concerned.
Tax receipts: Funere SA does not issue tax receipts. Whether your donation is tax-deductible and whether a certificate is issued depend exclusively on the beneficiary association and your tax situation; please contact the association concerned directly.
Limited liability: Funere SA cannot be held liable for the actions or internal management of the beneficiary associations, nor for their use of the donations received. For donations passing through its account on a transitional basis, Funere's liability is limited to the correct transfer of the funds collected to the designated association, less payment processing fees.
Payment processor: All payments for Funere Services are processed by our secure payment provider, Stripe. By providing payment information, you accept Stripe's terms and conditions and privacy policy. We do not directly process or store your full credit card details.
Currency and taxes: All fees are indicated and invoiced in Swiss francs (CHF). Unless otherwise indicated at the time of purchase, displayed prices are inclusive of Swiss VAT. We comply with Swiss tax legislation. You are responsible for all other taxes applicable to your situation.
Invoicing: For paid services, invoicing occurs at the time the service is activated or the order is confirmed.
Order fulfilment: Funeral homes, florists and other professional providers who fulfil orders (in particular the preparation and delivery of memorial flowers) act as fulfilment partners of Funere SA, which remains the customer's sole contracting party.
Invoicing and settlement: Unless otherwise agreed, partners invoice their services to Funere SA. Funere settles the invoices for transmitted orders on a monthly basis, at the end of each month. The amounts due to partners are net of Funere's remuneration, which is already deducted or included in the conditions agreed with each partner.
Special conditions: Special partnership conditions agreed between Funere and the partner may supplement or specify these Terms. In the event of a discrepancy, the special conditions prevail in the relationship between Funere and the partner concerned.
By using Funere, you agree to use the Service responsibly and respectfully, particularly given the sensitive nature of memorial services.
Respectful and lawful use:
Use the Service only for legitimate memorial purposes
Respect the memory of the deceased and the sensitivity of bereaved families
Refrain from publishing false, misleading or defamatory information
Do not use the Service for illegal activities or activities contrary to public morals
Appropriate content:
Ensure the truthfulness of the information provided when publishing notices or placing an order
Use respectful and appropriate language in condolences, testimonials and accompanying messages
Refrain from publishing offensive, discriminatory or inappropriate content
Respect copyright and intellectual property rights in shared photos and texts
Technical security:
Do not introduce viruses, malware or harmful code
Do not attempt to gain unauthorised access to systems
Do not disrupt the integrity or performance of the Service
Refrain from using automated scripts without authorisation
Commercial use:
Do not resell access to the Service without written authorisation
Do not use site data for unauthorised commercial purposes
Comply with usage limitations for free accounts
If you violate these obligations, we may suspend or terminate your account, and you may be subject to legal consequences.
Our intellectual property: The Service, including all software, source code, design elements, logos, trademarks, presentation and organisation of content, is the intellectual property of Funere SA or its licensors. The unique layout, design and features of the site remain our property even where the underlying data comes from public sources.
We grant you a limited, non-exclusive, non-transferable and revocable licence to use the Service for personal and memorial purposes, in accordance with these Terms. You do not acquire any ownership rights in the Service itself.
User content: You retain all rights to the content you publish (death notices, photos, testimonials, condolences, accompanying messages). By publishing content, you grant us a limited licence to host it, display it, transmit it to our fulfilment partners where necessary for the fulfilment of an order, and process it as required by the Service. This licence includes the ability to present the content to visitors of the site and to retain it for memorial archiving purposes.
Respect for third-party rights: You warrant that you have the necessary rights to any content you publish and that it does not infringe the rights of third parties. You undertake not to publish photos, texts or other elements protected by copyright without appropriate authorisation.
We process personal data in accordance with the GDPR and Swiss data protection law (FADP). Given the sensitive nature of memorial information:

Sensitive data: We treat all information relating to deceased persons and bereaved families with particular care. Access to this data is strictly limited to authorised personnel, the fulfilment partners concerned and the legitimate purposes of the Service.
User rights: In accordance with applicable regulations, you have rights of access, rectification, deletion and portability of your data. For data relating to deceased persons, requests may be handled by close family members or legal representatives.

The Funere Service may integrate with or provide links to third-party services, including:
Stripe for payment processing, including Stripe Connect for donations paid directly to associations
Funeral homes, florists and planting partners for the fulfilment of orders
Mapping services for locating funeral homes
Beneficiary associations of memorial donations
We are not responsible for the content, policies or practices of these third-party services in their direct relations with you. Their respective terms apply to your direct interactions with them. However, we select our partners carefully to ensure the quality and security of the integrated services. Where a partner acts as a fulfilment partner for an order placed with Funere, Article 13 applies.
Service provided "AS IS": funere.com is provided "as is" and "as available". While we strive to offer a reliable Service suited to memorial needs, we do not guarantee that the Service will be uninterrupted, error-free or entirely free of technical issues.
Limitation of liability: To the fullest extent permitted by law, Funere SA will not be liable for indirect, incidental or consequential damages arising from:
Errors or omissions in data published by third parties
Temporary interruptions of the Service
Disputes concerning the accuracy of memorial information
Technical problems affecting the availability of content
Delays or changes in fulfilment due to inaccurate information provided by the customer or circumstances beyond our control
For orders of memorial flowers and trees, Funere's liability is in any event limited to the refund of the price paid for the order concerned.
Exceptions: This limitation does not apply in cases of gross negligence, wilful misconduct or fraud on our part, nor to liabilities that cannot be excluded under Swiss law.
Backup and archiving: We maintain regular backups and data protection measures, which are particularly important for the preservation of memorial content. However, we do not guarantee the full restoration of all data in every possible scenario.
You agree to indemnify and hold Funere SA harmless from any liability regarding claims, losses or damages (including legal fees) arising from:
Your violation of these Terms
Your misuse of the Service
The publication of inaccurate or defamatory information
Any infringement of third-party rights by your content
Any dispute with third parties arising from your use of the Service
This indemnification obligation survives any termination of your account or of this agreement.
By you: You may stop using the Service at any time. To close your account, follow the instructions in your settings or contact us. We recommend exporting important data before closure, as access will be permanently removed. Published memorial content may remain accessible in order to preserve the memory of the deceased, unless explicit deletion is requested. Closing your account does not affect orders already paid, which remain governed by these Terms.
By us: We may suspend or terminate your access in the following circumstances:
Violation of these Terms or inappropriate use of the Service
Publication of manifestly false or defamatory information
Disrespectful behaviour towards bereaved families
Illegal activities or security threats
Non-payment of ordered services
Memorial preservation: In the event of account termination, legitimate memorial content (death notices, respectful condolences) may be retained in order to preserve the memory of the deceased, in line with our mission of public memorial service.
Discontinuation of the service: If Funere SA were to cease its activities, we would provide at least 60 days' notice and take measures to preserve access to memorial content, potentially through transfer to an appropriate organisation.
Funere SA may revise these Terms to adapt to legal, technical or service developments. Significant changes will be notified to you by email or by a visible notice on the site, with an appropriate notice period given the continuous nature of memorial services.
Continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms. If you do not accept the changes, you must stop using the Service. Orders already concluded remain governed by the version of the Terms in force at the time of their conclusion.
These Terms are governed exclusively by Swiss law, without regard to conflict-of-law principles. The application of the Vienna Convention on Contracts for the International Sale of Goods is expressly excluded.
Any dispute will be subject to the exclusive jurisdiction of the competent courts of Lugano, Canton of Ticino, Switzerland. Consumers residing in Switzerland may have the right to bring proceedings in their canton of residence under the applicable mandatory provisions.
Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Funere SA regarding the Service.
Severability: If a provision is found to be invalid, it will be modified to the minimum extent necessary or removed, with the remaining provisions remaining in force.
No waiver: Our failure to enforce a provision does not constitute a waiver of that provision.
Assignment: You may not assign your rights without our consent. We may assign this agreement in the context of a corporate restructuring.

Language: These Terms are a translation of the French version. In the event of any divergence of interpretation between the language versions, the French version shall prevail.
